Logbuilder warrants that the log shell structure will be free from defects in materials and workmanship provided by Logbuilder for a period of twelve months (12) from the date the log package gas been set. A warranty claim or other cause of action arising under this agreement, including this warranty, must be filed within four (4) months of the expiration of this warranty. If not, the unresolved or undiscovered claim is waived. The limited warranty given in this paragraph is the sole and exclusive warranty provided by the Logbuilder to Owner of said contract (non-transferable), and Logbuilder expressly disclaims and excludes any warranty for the log shell structure of merchantability or fitness for any particular purpose. Owners’ sole remedy under this limited warranty is Logbuilder’s repair (at Logbuilder’s discretion) of the portion of the log shell structure that is defective. Every reasonable effort is made by the Logbuilder to build an airtight structure, some checking, twisting and shrinking of wood members resulting in their separation will take place. The Owner acknowledges that they have been informed about the normal settling and shrinkage in log buildings and those natural occurrences are not covered by the limited warranty given here. Logbuilder’s limited warranty does not apply to damage to the log shell structure caused by improper cuts in and installations to the log shell made by others. Warranty work performed by Logbuilder does not extend the warranty. This warranty is void if a person of another firm other than this Logbuilder performs or re-performs any work within the scope of this agreement. Logbuilder is not responsible for consequential damages. Manufactured or consumer products, such as windows, doors, hardware, etc. are not separately warranted by the logbuilder. In the event owner encounters a defect in a manufactured or supplied product, logbuilder shall assist owner in securing the repair or replacement of these products pursuant to the particular manufactures or distributor’s warranty.
